Mood Music Limited - Terms & Conditions of Trade
All
orders for goods made by you and accepted by Mood Music Ltd are
subject exclusively and strictly to these Terms & Conditions
of Trade:
1) Orders
All orders made by you through this web site are subject to
acceptance by us. We may choose not to accept your order for
any reason.
2) Age Restrictions
You must be 18 years or older to use this site.
a) Once you have processed your order please check the
details carefully before providing your credit card details.
Orders which have been paid for through this site will be
deemed to have been made by you and the details of your purchase
to be correct.
b) All the details of products on this web site are correct,
in as far as we are aware, at the time of being posted on
to it. Please check all goods upon receipt to ensure that
you have received the correct item/s and that they are not
faulty.
c) Promotional and sale items are offered for sale at such prices
only for the time specified. It is the nature of “on
demand” production that changes can be made to a product,
as required by the copyright owner, or to include or exclude
enhanced data, therefore items offered for sale may vary significantly
over time.
d) Given (c) the price and specification of
any product on the site may vary for any reason and this will
be entirely at our discretion.
4) Payment & Taxes
a) The
cost to you of goods will be displayed at the point of payment.
Postage and packing at £1.99 will be added to each order.
VAT is included in the cost that is shown. Your credit or
debit card issuers may make charges for using this service
for which Mood Music Ltd accept no liability.
b) Payment can be made by most major credit or debit cards. Payment
will be debited from your account upon the order being completed.
The instruction to manufacture your selected product and despatch
it will then be made.
c) Both our bankers and ourselves require that you confirm that
the credit or debit card that is being used is your own and
that you are entitled to use it. The card issuer and ourselves
require that we carry out authorization and validation checks
for each transaction. Should the card issuer refuse to authorize
payment, we will not be liable for any delay or non-delivery
and we are not obliged to inform you of the refusal.
d) VAT is, at present, charged on all transactions. Any and all
other charges such as import duties are your responsibility
and not that of Mood Music Ltd. If you are not liable to VAT
please contact Mood Music Ltd using any of the methods displayed
on the site.
5) Delivery & Loss Of Items In The Post
a) We aim to dispatch items ordered by you normally
within forty eight hours by Royal Mail in the UK. Delivery
charges are £1.99 per item. We cannot accept liability
for late receipt of goods by you.
b) Products will be despatched to the address you have entered
when you ordered the goods.
c) If your goods do not arrive within four days you must contact
Mood Music Ltd by letter or email so that we may investigate
whether it has been lost in the post.
6) Returns
Any
faulty Compact Discs sold by Mood Music Ltd must be received by
Mood Music Ltd within 20 days of delivery for a full refund. We
will not accept any item that is not in its original condition,
is damaged, has missing parts, or that our software shows to have
been copied. In addition we will cross check our database to verify
that the return is genuine. We will have the CD independently
verified to ascertain whether the CD is either:
a) genuinely unplayable i.e. the product was faulty.
or
b) or if there is an incompatibility issue
with the disc and any of
If (a) is the case Mood Music will provide
a replacement CD free of charge.Faulty returns will be authorized
and agreed upon within 20 days of receipt of returned goods.
Where (b) is the case, we advise that, whilst
our CDs are compatible with most of the commercially available
Compact Disc players, there may be some hardware in the market
incompatible with the playing of “on demand” CDs.
We endeavour, however, to keep pace with the latest development
of Compact Discs and players and only supply items with the
highest compatibility rate.
7) Right To Withdraw Items From Sale
a) We reserve the right to withdraw any items from the
site at any time.
b) We will not be liable to you or anyone else for withdrawing
any items from the site or refusing to process an order.
8) Limitation Of Liability
a) To the fullest extent permissible under law, we disclaim any and all warranties of any kind, (whether express or implied,) in relation to goods purchased by you through the this web site. Your statutory rights as a consumer are not affected.
b) Our liability in contract, tort, negligence, pre-contract or other representations or otherwise arising out of or in connection with these Terms & Conditions of Trade shall be limited in aggregate to all sums paid by you to us.
c) In any event, we shall not be liable to you under, or in connection with these Terms & Conditions of Trade in contract, tort, negligence, pre-contract or other representations (other than fraudulent or negligent representations) or otherwise for any economic loss (including without limitation loss of revenues, profits, contracts, business or anticipated savings) or for any special or indirect losses whatsoever.
d) Nothing in these Terms & Conditions of Trade shall exclude or limit liability for death or personal injury resulting from our negligence or that of our agents or employees.
9) Security & Privacy Of Data
You should read our Security & Privacy Statement (which, for the avoidance of doubt, do not form part of these Terms & Conditions of Trade).
10) Severance
Each provision of these Terms & Conditions of Trade shall be construed separately and independently of each other and the invalidity of any one part shall not affect the validity of any other part.
11) Law
These Terms & Conditions of Trade shall be governed by the laws of England and you agree to submit to the exclusive jurisdiction of the High Court of England & Wales.
12) Changes To These Terms & Conditions Of Trade
We may change these Terms & Conditions of Trade at any time.
